2.1. These Terms and Conditions apply between Customer and Anyday in regards to credit sale via the Product. The Terms and Conditions in force at any time are available on www.anyday.io.
3.1. The Customer applies for an Anyday Credit Line. If the Customer is considered creditworthy inaccordance with section 4, the Customer receives an Anyday Credit Line that gives a maximum loanamount. Such may the Customer draw from in relation to future purchases by using the Product asspecifically agreed.3.2. The first time the Customer uses the Product, the Customer will be led through a sign-up process. TheCustomer must enter their information for the use of credit rating, unique identification and payment.The Customer shall enter their payment information, that will be kept for the initiation of futurepayments.3.3. Upon all purchases, an Anyday Credit Agreement is entered into for the specific purchase/order amount,if the Customer is considered creditworthy. Subsequently, the Customer chooses an installment planand confirms the purchase. The payment plan will be visualized at every purchase.Anyday Finance A/S • P. O. The Customer must be of legal age, possess a valid payment card, Danish social-security number (CPR),and be registered with a Danish address in the Danish national register.4.2. Anyday conducts a credit scoring of the Customer. Anyday uses third-parties to assist in this process.The Customer will be asked to provide information about their economy etc. The credit scoring willresult in the Customer being either approved or declined. The result of the credit scoring is solelydetermined by Anyday.4.3. In relation to a purchase, Anyday may at any time conduct and/or request the Customer to giveinformation for a new credit scoring. The result hereof cannot affect purchases already made but maypreclude or change the Customer’s usage of the Product.4.4. Should the Customer request the use of the Product for a purchase that surpasses the amount Anydaycan offer the Customer, the Customer may be offered a credit agreement through a financing partnerof Anyday. Under such circumstances, Anyday is solely acting as a credit intermediary and cannot beheld accountable for the credit agreement and the following contractual relationship between theCustomer and such financing partner.5. Contractual relation5.1. Anyday is not responsible for the goods or services that are paid for with the Product.Complaints and inquiries related to the goods or services must be directed to the Shop. The Customerhas certain rights, which is described in the Anyday Credit Agreement.5.2. Should the Customer fail to pay their Monthly Installment punctually, the Customer will be precludedfrom using the Product as payment method for subsequent purchases. The Customer will be able to usethe Product as payment method when the Amount Due has been paid unless any of the Customer’sAnyday Credit Agreement(s) has been assigned for debt collection, or if the Customer has demonstratedsuspicious behavior.5.3. The Anyday Credit Line and the Anyday Credit Agreement is personal to the Customer and may not beused by others.6. Payment terms6.1. The Customer pays the Monthly Installment every month. The Customer chooses the relevantinstallment plan for each purchase.6.2. Anyday will authorize the First Installment on the Customers payment card at each purchase. The FirstInstallment will be finally withdrawn upon shipping of the goods from the Shop, which also will beconsidered the due date of the First Installment. Following, the Monthly Installment will be paid withthe last banking day as due date. If the due date of the First Installment is from the 1st to the 16th of amonth, the due dates of the following installments will be the last banking date in that month and thefollowing months. If the due date of the First Installment is after the 16th of a month, the due date ofthe following installments will be the last banking date in each of the following months. The remainingamount shall always be paid over the agreed number of installments. Anyday is entitled to adjust thenumber of installments for new purchases or the choice hereof.Anyday Finance A/S • P. The Customer accepts that Anyday can perform an automatic withdrawal on the Customers paymentcard, in accordance with the Conditions for automatic card payments.6.4. The Customer must at any time have a valid and active payment card attached to their account. VISA,MasterCard, and Visa/Dankort are all applicable. Withdrawal of consent for Anyday’s accessibility to usethe payment card for payments according to the Anyday Credit Agreement, will be considered as asignificant violation of the Anyday Credit Agreement in accordance with clause 11.6.5. The Customer can manually make extra payments to cover the current month’s Monthly Installmentand the following months’ installments and/or to cover any additional costs. Such extra payments aremade via the Customer’s account in My Anyday.7. Late payment7.1. In case of missing or delayed payments, Anyday may add late fees, collection fees, default interest (theDanish National Bank’s official lending rate added 8%) and other costs according to current legislation.Missing payment may also result in transfer of the case to collection and registration in RKI. Anyday willtry to contact the Customer via email and/or phone before a late fee process is initiated.7.2. Should Anyday not be able to complete a payment of the Monthly Installment in the subscribed paymentcard, for reasons caused by the Customer, Anyday will be entitled to withdraw the Amount Due viaNETS Betalingsservice. Any such payment will be a one-off occurrence and the Customer must makeautomatic card payments available immediately hereafter.8. Flexible payment8.1. The Customer may choose to pay a larger First Installment than dictated by the chosen installment plan.The following payment plan follows the structure as mentioned in section 6.1 and 6.2.9. Messages9.1. Messages will be sent to the Customer via email, text message (SMS), or push-notifications via app.10. Contact information and payment information10.1. It is the Customer’s responsibility that their contact information including address, email address andphone number is always updated and correct. Additionally, the Customer must make sure that theinformation about the Customer’s payment card is always correct and updated, for example uponexpiration, change of bank, closed card, loss, or for any other reason. A new payment card will notautomatically be subscribed. Changes can be conducted in My Anyday or by contactingshopper@anyday.io. For safety reasons, payment card information should never be sent via email.11. Violation11.1. In case the Customer violates the Anyday Credit Agreement or the Anyday Credit Line, Anyday mayterminate either or both of the agreements. Consequences of and acts that leads to termination of theAnyday Credit Line or the Anyday Credit Agreement are described in the agreements respectively.Anyday Finance A/S • P. O. Withdrawing the purchase of the good or service where the Product has been used as payment solutionmust be directed to the Shop in question and will follow the rules of this Shop. When the refund isaccepted by the Shop, the Anyday Credit Agreement is also considered withdrawn from, if this happenswithin 14 days after entering into the agreement, see also section 12.2 below. The relevant amount willbe refunded to the Customer’s payment card unless the Customer has an Amount Due from otherAnyday Credit Agreement(s). In that case, the amount to be refunded will be refunded to the TotalBalance until the Amount Due is DKK 0,00.12.2. If the Customer does not want withdraw from the purchase of the good, the Customer may withdrawfrom only the Anyday Credit Agreement without any reason by informing Anyday via email, telephoneor letter. The Customer may use the standard withdrawal form below.The Customer must inform Anyday about the withdrawal from the Anyday Credit Agreement within 14days after the day where the Anyday Credit Agreement was entered into. If the deadline expires on anational holiday, Saturday or Constitution Day, Christmas Eve’s Day or New Year’s Eve Day, theCustomer may wait until the next working day.Soon, and no later than 30 days after the Customer has informed Anyday about its withdrawal of theAnyday Credit Agreement, the Customer must pay the Total Balance originating from any related AnydayCredit Agreement(s).12.3. The Customer may withdraw from the Anyday Credit Line without any reason by informing Anyday viaemail, telephone or letter. The Customer may use the standard withdrawal form below.The Customer must inform Anyday about the withdrawal of the Anyday Credit Line within 14 daysafter the day where the Anyday Credit Line was entered into. If the deadline expires on a nationalholiday, Saturday or Constitution Day, Christmas Eve’s Day or New Year’s Eve Day, the Customer maywait until the next working day.If the Customer has utilized his/her Credit Line, the Customer must pay the Total Balance originatingfrom any related Anyday Credit Agreement(s) soon and no later than 30 days after the Customer hasinformed Anyday about its withdrawal of the Anyday Credit Line.12.4. Anyday can assign their rights and obligations in the Agreements to a third-party without seekingconsent from the Customer.14. Processing of personal data14.1. The Customer’s personal data is processed in accordance with Anyday’s privacy policy, which is availableat: www.anyday.io/gdpr/privacy-policy-shopper.15. Choice of law and venue15.1. Danish law applies unless mandatory Customer protective legislation in the Customer’s country ofresidence demands otherwise.15.2. The relation between the Customer and Anyday is not covered by a guarantee fund or scheme.16. Complaint procedure16.1. The Customer can submit complaints about the Terms and Conditions, Terms and conditions forautomatic card payments, the Anyday Credit Line or the Anyday Credit Agreement toshopper@anyday.io.16.2. Should an agreement not be reached by addressing the complaint to Anyday, the Customer may submitcomplaints to Mæglingsteamet for Forbrugerklager, Nævnenes Hus, Toldboden 2, 8800 Viborg,Denmark. You may submit complaints to Mæglingsteamet for Forbrugerklager via “Klageportalen forNævnenes Hus” (the Complaint Portal at the Danish Appeals Boards Authority) available at:https://kpo.naevneneshus.dk. The mediation team will attempt to solve ethe dispute by mediation, andif that is unsuccessful, you may refer the case to the Danish Consumer Board of Appeal.The opportunity to complaint is conditioned that you paid between 1.110 kr. and 100.000 kr. for thegood or service. The limit may change. You must pay a fee to have the complaint processed.16.3. The Customer can also choose to submit complaints to the EU's online portal. The complaint can besubmitted at: http://ec.europa.eu/odr. Upon submitting a complaint Anyday’s email address must beindicated as: shopper@anyday.io.16.4. When you use a service with e-mærket, you may have your case processed for free, regardless of thesize of the amount. Read more here.Terms and conditions for automatic card payments1. Scope1.1. These Terms and conditions for automatic card payments constitute an integral part of the agreementbetween the Customer and Anyday.Anyday Finance A/S • P. O. The payment card the Customer has subscribed to their Anyday account is saved and subsequentlyused by Anyday to conduct automatic card payments.2.2. The First Installment and any Monthly Installment originating from any Anyday Credit Agreement arewithdrawn from the Customer’s subscribed payment card on the agreed due dates. Should it not bepossible to withdraw the Monthly Installment on the agreed due date, Anyday will initiate an automaticcard payment on the 1st and 2nd of the following month.3. Rejection, objection, and withdrawal of consent3.1. Anyday will send an email every month containing information about the current month’s paymentoverview. Should the Customer wish to reject the payment (for example if the Customer considers theamount to be incorrect) Anyday should be informed at shopper@anyday.io no later than the day beforethe agreed due date. Rejection of payment is considered a violation of the Anyday Credit Agreement,unless the Customer has arranged the payment to be made punctually by other means.3.2. Objections to already completed payments can be directed to shopper@anyday.io. Alternatively, theCustomer may contact their own bank/payment card provider.3.3. The Customer has a right to withdraw their consent to Anyday’s continued use of the Customer’spayment card for automatic card payment. Withdrawal is made on communication toshopper@anyday.io. Withdrawal of consent is considered a violation, according to clause 11 of theTerms and Conditions, unless the Customer has arranged the payment to be made punctually by othermeans.4. Security4.1. The Customer’s payment card information is registered and kept safely at a third-party that has beenapproved by international security standards. Anyday only has access to the first six and the last fourdigits of the card number, as these are required to identify the card that is subscribed to the Customer’sAnyday account. Anyday keeps the card’s expiration date for the purpose of providing support to theCustomer and for informing the Customer via email before the expiration of the payment card.
